NECA Standing Policy on Diversity and Inclusion

Key Legislation

H.R. 227- Incentivizing Fairness in Subcontracting Act

  • This legislation would allow subcontractors a proper channel to file a formal notification to the federal government on their lack of prompt payment. The dispute process would go through the Office of Small and Disadvantaged Business Utilization (‘OSDBU’) and would require a determination of the validity of a claim and the intended resolution process.
  • Establishes a study to determine if general contractors are meeting their small business concerns described in their subcontracting plan.
  • The legislation gives further explanation as to how prime contractors may elect to receive credit for small business concerns performing as first tier subcontractors or subcontractors at any tier for the dollar amount serviced by that given subcontractor. 

H.R. 190 – Expanding Contracting Opportunities for Small Businesses Act of 2019

  • Establishes as study to determine if contracting officers are accurately certifying businesses to receive sole-source contracts, and if these officers are properly classifying sole-source contracts.
  • Requires the Small Business Advocate to implement a front-end certification program for women-owned, and service-disabled veteran businesses.
  • Ties to inflation and increases the dollar threshold for awarding sole source contracts to HUBZone, women-owned, and service-disabled veteran businesses
